A TikTok star has been sued for $3.5million over allegedly stealing a woman's ex-husband and ruining their marriage. Social media sensation Brenay Kennard is accused of breaking up the marriage of Timothy Montague, who is now her husband, and his ex-wife Akira. Akira sued the content creator for alienation of affection, a scarcely seen claim that allows an individual to sue a third party for allegedly causing their marriage to end. In her complaint, seen by PEOPLE, Akira is demanded $3.5 million in both punitive and compensatory damages. Kennard, who has nearly three million followers on TikTok for her food reviews and recipe videos, chose to represent herself in the sensational case. The complaint alleges that Kennard started to make content with Timothy while he was still in a relationship with Akira. According to the suit, Akira alleged that the posts were made 'without Akira's knowledge or consent'. She also accused Kennard of publicly sharing pictures of her and her ex's children, while adding that Kennard 'flaunted' their alleged affair online. The lawsuit has already resulted in a bevy of stunning moments in court as the trio battled it out. According to The News & Observer, Timothy testified on Thursday that he never even loved his ex-wife. He told the court: 'We were just like roommates', adding that when he did get down on one knee he used the cheapest ring he could find. Timothy's sister Imani said that her brother had been 'a terrible husband' whose marriage caused a 'hostile' living environment. She claimed the stress caused by the couple's marriage was so severe that it made her drop out of college. Kennard testified that she had started living with Akira and Timothy around December 2023 due to problems with her ex-husband. However, she said she never knew Akira was 'uncomfortable' with her presence, the outlet reported. Akira's attorney Robonetta Jones responded by referring to a text message in which her client said: 'Brenay has to leave. By noon.' Video from last year of Kennard expressing that she was anxious to become 'Mrs. Montague' was shown in court. The prosecution reportedly also displayed footage of the TikTok influence 'twerking' on Timothy in the bathroom. Kennard testified that she was drunk when the clips were filmed. In order to win her alienation of affection case, Akira will have to prove three items. The first is that her marriage to Timothy was genuine with 'some degree of love and affection' existing. The second is that the couple's love was 'seriously diminished or destroyed.' The last is that the third party in their collective relationship - in this case, Kennard - was responsible for their relationship dissolving. North Carolina is one of the only six US states that still permits alienation of affection lawsuits.
