The central government also did not object to the petition. During the hearing, Justice LS Pirzada cited Section 4(3) of Schedule 2 of the Passport Rules, 1980. He stated that if the parents are separated but have not formally divorced, the consent of one parent is required. He stated that in this case, a divorce decree has been issued, and the children are in the mother’s custody under the MoU.
