LHC DB recuses itself from hearing Niazi’s plea

LAHORE: A division bench of the Lahore High Court on Thursday recused itself from hearing an appeal of Barrister Hassaan Niazi, a nephew of former PTI chairman Imran Khan, against his trial in a military court and requested the chief justice to fix it before the same bench previously seized with the matter. The bench headed by Justice Farooq Haider noted that the appeal was previously heard by a two-judge bench headed by Justice Sultan Tanvir Ahmad. Justice Farooq Haider stated that Justice Sultan Tavir Ahmad was available at the principal seat, therefore, the appeal should be heard by the same bench and sent the appeal to the chief justice with a request to fix the same before some appropriate bench. The appellant through his counsel contended in his appeal that following his arrest in the May 9 case, Hassaan Niazi was not produced before a civilian court, instead, Sarwar Road police handed him over to military custody which was unlawful and carried out without any judicial order. He asked the court to declare the commanding officer’s notification null and void, authorizing his custody by the military. He also sought to set aside his transfer to military custody and all subsequent proceedings conducted by the military court. Hassaan Niazi was sentenced to ten years imprisonment in December 2023 in the Corps Commander House attack case. Copyright Business Recorder, 2025
