Attorney General Pam Bondi said she is reviewing former President Joe Biden's alleged use of the to sign off on presidential pardons. Bondi's order follows a report released by the GOP Oversight Committee calling for a void of all pardons and executive orders that were allegedly signed with an autopen. But is it possible to legally cancel out a pardon? Former U.S. Attorney John Fishwick told The National News Desk that it is something that has never been done before. We're in uncharted territory. Nobody in the history of our country has ever tried to undo actions by a president, particularly as relates to a pardon. So we're in uncharted territory, but I think it's fair game to study all of this. After all, the auto pen was used," Fishwick said. Fishwick said Bondi's investigation will tie into Biden's alleged mental decline in office. "There's no question that, sadly, President Biden was in mental decline at that time, and so did he know what he was doing?" Fishwick said. Fishwick said you can use an autopen to give a pardon, but the president needs to be the one who is doing the action. The Oversight Committee Autopen Report released a statement that said in the final hours of the presidency, the pardon was allegedly communicated secondhand to an aide. Whether Biden was the one signing off on the actions could relate to his health. Although Biden's doctor refused to testify, Fishwick said they can obtain Biden's medical records through a subpoena. Fishwick said whether or not a pardon can be overturned is an "uphill climb." But if there is no documentation of whether Biden was the one to approve the pardon or the order, Fishwick said it is "fair game" to question if Biden approved of them or if it was someone else, especially if there is proof of mental decline. If there is an auto pen, it's fair game to say, hey, look, where's the documentation that President Biden authorized this pardon? And why did he authorize this pardon," Fishwick said.
