New Delhi: US President Donald Trump has made a major decision regarding the H-1B visa which has shaken the global technology and immigration system. Trump signed an executive order titled Restrictions on Entry of Certain Nonimmigrant Workers. Under this the H-1B visa fee has been increased to $100000 (approximately Rs. 88 lakh). Trumps announcement has created confusion among H-1B workers working in the USA.
If visas are already issued
The H-1B visa allows American companies to hire foreign workers. Foreign workers in the technology engineering and medicine fields are employed through the H-1B visa. Indians working in the US tech sector work on H-1B visas. H-1B visa workers are extremely worried after Trumps decision. They are unsure whether they will now have to pay visa fees even though their visas have already been issued. Lets understand.
How did the confusion arise?
After the issuance of the executive order an atmosphere of chaos arose. Immigration lawyers issued warnings. Companies began to understand the dangers of the rules. Many H-1B visa workers began to fear that if they did not arrive in the United States on time they would also have to pay a fee of $100000. Some media reports indicated that companies had instructed their workers to return to the United States immediately if they had gone abroad.
The way the executive order signed by Trump was worded created confusion. It stated that the $100000 fee would apply to immigrant workers. This led to the impression that any worker entering or working in the country would now have to pay this fee.
White House issues statement clears up confusion
However the White House soon issued a statement clearing up all confusion regarding the H-1B visa in three points.
Here they are:
The $100000 fee is not an annual fee but a one-time fee. This fee will be applicable only when filing a new H-1B visa application.
The new visa fee will not affect existing H-1B visa holders. Those who are outside the USA will not be required to pay this fee upon their return.
Renewals and extensions for existing visa holders will continue under the previous fee structure.
A senior US government official also reiterated this stance telling ANI Those coming to India going out of India or travelling to India will not be required to return before Sunday or pay the $100000 fee. This fee will apply to new visa applications.
