A US federal court in Texas has fixed February 1, 2027, as the start date for a jury trial in the ongoing litigation involving US-based Cognizant Technology Solutions and Indian IT services giant Infosys, which has an offshore presence in the US.
The trial will be heard with a pretrial conference scheduled for January 25, 2027, according to an order issued on September 5 by the US District Court Northern District of Texas Dallas Division.
The source of the legal dispute between Infosys and Cognizant dates back to last year, and involves accusations of trade secret theft and anti-competitive practices. Cognizant claims that the Bengaluru-based IT company stole trade secrets related to Cognizant’s healthcare platform, TriZetto.
However, Infosys’ counterclaim is that Cognizant is using its market position to hinder Infosys’ development of a competing platform.
Court Deadline
The court directed both parties to complete fact discovery by March 11, 2026, and expert discovery by June 25, 2026.
Parties must designate their expert witnesses by April 16, 2026, with rebuttal designations due by June 4, 2026, the order said. These expert testimonies are expected to be critical, given the complexity of antitrust allegations involving pricing, client contracts and competitive market structures, the order added.
Mediation for both parties
Before heading to trial, the Court had mandated mediation by July 9, 2026, with parties required to report on their choice of mediator or inability to agree by July 16, 2026. A joint update on settlement discussions is also due by the same date, reflecting the court’s push for a potential resolution without the need for a lengthy trial.
The court ordered both parties to be prepared for trial on 48-hours’ notice once the February 2027 docket opens, the order said.
The case is being closely followed across the technology services sector, as its outcome could have broader implications for competition and contracting practices in the global IT outsourcing industry.
