Sia and estranged husband Dan Bernad’s ongoing divorce is getting messier. According to court documents obtained by Us Weekly on Tuesday, October 28, Bernad has filed for sole legal and physical custody of his and Sia’s 19-month-old son, Summi. Bernad requested that Sia have “monitored visitation” three times per week. He also asked for Sia, 49, to “submit to random and regular drug testing” and sobriety testing prior to each supervised visit. Bernad claimed that Sia “is a serious and immediate danger” to their son. He alleged that the pop star was secretly hospitalized for two weeks in September and tested positive for barbiturates and benzodiazepines. “Sia is an unfit and unreliable parent struggling with substance abuse and addiction, rendering her incapable of providing safe or stable care for Summi,” Bernard claimed in his declaration. “I am the only safe and reliable parent for our son. I am a doctor, young, healthy, and have no criminal history or drug or alcohol addiction issues.” Bernad is also seeking $77,245 a month in child support, claiming that he gave up his job as a doctor after marrying Sia in 2023 and instead opened a ketamine clinic following her request. Sia filed a response to Bernad’s petition on Tuesday, slamming his allegations. The docs stated that Sia has “been sober for over six months,” adding that the Grammy winner has “repeatedly agreed to drug testing and requested that both she and Dan undergo regular drug testing.” Sia claimed that Bernad “refused to get drug tested on a regular basis.” “It is true that I struggled with drug and alcohol issues more than fifteen years ago. I have been fully sober for over six months and working my program which includes weekly testing and a sober companion,” Sia wrote in her declaration. “My recovery has been a cornerstone of my life and one of the primary reasons I chose to separate from Dan, whose ongoing engagement in a nightlife and recreational drug-use lifestyle is incompatible with a healthy environment for our child.” Sia slammed her ex for attempting to “weaponize” her “past sobriety journey” against her while seeking full custody. She also claimed that Bernad underwent monitored visits with their son due to an alleged child porn investigation. “I was informed that Dan was being investigated by the Los Angeles Police Department (LAPD) and Department of Child and Family Services (DCFS) for allegations of having child pornography,” Sia claimed. “I demanded and Dan agreed that his visitation with Summi be in the presence of professional custody monitors.” Sia stated that the investigation was “closed” and the results were “inconclusive.” Us has reached out to Sia and Bernad for comment. Sia and Bernad tied the knot in May 2023 in Portofino, Italy. The pair quietly welcomed their first child together, Summi, in April 2024. Sia is mother of two sons she adopted as teens in 2019. Earlier this year, Sia filed for divorce from Bernad after nearly two years of marriage. The “Cheap Thrills” singer cited “irreconcilable differences” as the reason for the split.
