The Rajasthan High Court has allowed six-month interim bail to self-styled godman Asaram Bapu on medical grounds. The 82-year-old Asaram who is serving a life sentence after being convicted of rape was given bail after his lawyers filed a plea with medical reports of various ailments which he needs treatment for outside jail. Rajasthan HC take on Asarams health He is suffering from various ailments and is in need of regular hospital visits and expert care which are not available in prison his plea said. Observing that Asaram was 82 years old and had multiple medical conditions the court said he should be given a chance to get treated outside the jail. On the basis of the facts placed before it the High Court allowed Asaram interim bail for six months citing on health grounds only and not on the merits of his conviction. The court while granting bail imposed conditions that the petitioner should remain at the medical facility and report the progress of his treatment. It also said that if the interim bail is misused or for any other purpose other than treatment it will be liable to be cancelled forthwith. Observations made by Rajasthan HC Legal experts say that the order shows the court is trying to balance human rights with the administration of justice. Courts have the power to ensure that a prisoner even if convicted is given medical treatment if required. At the same time the court has clearly mentioned in its order that the gravity of the offence is no less serious just because the person has been granted bail on medical grounds.
