Garda injured while detaining a man for his own safety

A man who injured a Garda while he was being taken into custody for his own safety has significant mental health issues to deal with. This was the scenario outlined to Judge James Faughnan at Ballinasloe District Court in the case of Shane Walsh of Apartment 7, Cul an Eiscir, Ballinasloe. Gearóid Geraghty solr, defending, said he had a medical report outlining his client’s issues for the Judge to consider. Judge Faughnan had to decide if the matter before him could be dealt with in the District Court or if it should be sent forward to a higher court. The Judge heard that Walsh was detained by Gardaí for his own safety under the Mental Health Act. When he was put in the patrol car he obstructed a Garda and injured the Garda’s hand. He placed himself in the middle of the back seat and refused to move when instructed to do so. Grabbing and pulling ensued and in the course of this the Garda was injured. Judge Faughnan accepted jurisdiction and adjourned the matter until the December 4 sitting of Ballinasloe Court. This article is funded by Comisiún na Meán.
