Driver celebrates after court rules that people in Ohio can get a GAY licence plate

A driver in Ohio has won the right to have a licence plate that reads “GAY” after a court agreed that the state’s Bureau of Motor Vehicles (BMV) had “erred” in rejecting his request.

William Saki filed a lawsuit after the application for his desired car licence plate was rejected for being “inappropriate or invalid”, as were ones bearing the words “QUEER” and “HOMO”, according to The Buckeye Flame.

He argued that the plates would not violate any BMV guidelines, and found that plates that read “NO GAYS”, “NO HOMOS” and “STR8” were listed as available.

Saki filed a joint suit against the BMV and the Ohio Department of Public Safety, with Cyrus Mahdavi, who had been prevented from having a plate reading “MUSLIM”, despite the fact that “ATHEIST” and “BAPTIST” were permitted.

Judge Dan Aaron Polster dismissed the case on Thursday (10 September) after “representatives of the BMV conceded that [they] had erred in rejecting the vanity plates”.

The BMV also agreed to unlock the 62,000 “forbidden” words in its data base as long as they were not considered “offensive, disparaging or socially insensitive”, and promised to provide instructions for other applicants who believed their requests for customised plates had been wrongly rejected.

Lawyer Brian D Bardwell, who represented Saki, claimed that Ohio’s Republican governor Mike DeWine had “made a political career out of harassing gay people”, and that his client’s right to free speech meant he should have access to a licence plate that represented his identity.

Saki told The Buckeye Flame: “We got lucky with a judge who cut straight to the real question: are gay Ohioans free to come out and live our lives without the government forcing us back into the closet? Thankfully, our judge knew the right answer and ordered the BMV to let me say who I am.

“I can’t wait for my licence plate to come but it’s going to be hard waiting for my boyfriend to mount it on my rear end and screw it all the way in.”
