The CEO of Super Retail Group Anthony Heraghty has been sacked after the company discovered new information about an alleged secret relationship he had with its former HR boss, Jane Kelly.

Super Retail Group, which owns Supercheap Auto, Rebel Sport, Macpac, and outdoor chain BCF, confirmed the move in a statement to the Australian Stock Exchange (ASX) on Tuesday.

‘The board made this decision after receiving new information from Mr Heraghty regarding his relationship with the company’s former chief human resources officer,’ the company said.

‘In light of this new information, the board has concluded Mr Heraghty’s prior disclosures were not satisfactory.

‘The board has exercised its discretion to lapse Heraghty’s incentives, which includes all unvested incentives and vested but unexercised rights.’

Mr Heraghty was previously backed by the company against allegations about the apparent secret relationship, as well as claims of bullying and fostering a toxic work environment, which led to a lengthy legal battle in the Fedaral Court.

The company is being sued by its former chief legal officer, Rebecca Farrell, and senior lawyer Amelia Berczelly, who say they were bullied and harassed after flagging concerns about Heraghty’s alleged relationship with Ms Kelly.

Ms Farrell and Ms Berczelly lost their jobs at Super Retail last year after raising concerns that the affair was fueling a toxic workplace.

According to court documents, Ms Berczelly recalled seeing Mr Heraghty and Ms Kelly arrive together at the Calile Hotel in Brisbane in June 2023 for a senior managers’ meeting.

‘Heraghty and Kelly had acted in a manner that was very suspicious and suggestive that they were engaged in an intimate or personal relationship that had not been disclosed to the board,’ the court filings alleged.

‘(A staff member) had observed Heraghty resting his hand on Kelly’s thigh while the (executive leadership team) were drinking at a bar,’ the court documents alleged.

In August 2022, at an off-site leadership meeting in Manly, another staff member reportedly witnessed the pair in an alleged intimate moment.

‘Heraghty and Kelly had acted in a manner that was very suspicious and suggestive that they were engaged in an intimate or personal relationship that had not been disclosed to the board,’ the court filings alleged.

It is unclear if the court case launched by Ms Farrell and Ms Berczelly will continue.

The Daily Mail understands Mr Heraghty and Ms Kelly are separated from their respective spouses and both have children from those marriages.

Brisbane-based Super Retail Group has annual sales of $3.8billion, and Mr Heraghty received a total remuneration package of $4.15million in 2023.

Chief financial officer David Burns has been named interim chief executive.
