Sunjay Kapur’s widow Priya Kapur seeks Delhi HC nod to disclose late husband’s assets confidentially

Sona Comstar chairman Sunjay Kapur’s widow Priya Kapur on Thursday asked the Delhi High Court to allow her to furnish details of personal assets and liabilities of her late husband in a sealed cover or with a confidentiality clause as such disclosure in the public domain could cause irreparable harm, including possible cyber security threat.However, Justice Jyoti Singh, who had early this month asked for the details of all movable and immovable assets of the late businessman as of June 12, the day of his death, questioned Priya on how the opposing parties can file their submissions without having proper access to details of assets and bank accounts.“The whole suit cannot be in a sealed cover,” the judge said, while asking all the parties to “ponder” and come out with a via media that would satisfy everybody.” The case will be further heard on Fridat at 2.30 PM.While expressing apprehension that how the court could order filing of details in a sealed cover as it would impinge upon the parties’ right to question or verify the assets disclosed, Justice Singh said that such order may “problematic” for the other side. “they (Karisma Kapoor’s children] have a right to question the assets disclosed…So, tomorrow, if they have to verify and go about asking people what has happened, how can they do that when they are bound with confidentiality club… it should not affect their right to defend their case,” the court asked.Justice Singh also questioned Priya on how she can seek to file the list of Sunjay’s assets under a non-disclosure agreement (NDA) and in a sealed cover when it was unheard of in a partition suit.Live EventsSenior counsel Shyel Trehan, representing Priya, told the court that the details of the assets included sensitive information, including bank and demat account details, the disclosure of which could also makes it vulnerable to cyber security threat. “I am not shying away from disclosing any information, but media attention is already there. Pleadings are being leaked. Details are so specific that why should public at large get these details of the bank accounts,” the counsel argued, adding that either the documents be allowed to be filed in a sealed cover or a “Confidentiality Club” be constituted to limit access.Karishma’s children Samaira (20) and her 15-year-old brother opposed the Priya’s plea, arguing that the details regarding the property should largely remain public. They alleged that they have information that “banks accounts have been wiped off”, leaving nothing in the account and even they have no idea about what happened to the demat account.Senior counsel Amit Sibal and Vaibav Gaggar , representing Sunjay mother Rani, said that she must be given the copy of the March 21, 2025 Will and also the full access to the asset details so that it can be independently verified.Actor Karishma Kapoor’s children had moved the court seeking a share of their late father’s assets estimated to be worth Rs 30,000 crore. They have urged the court to declare them Class I legal heirs and direct a partition of their father’s estate, demanding a one-fifth share each. Being Class I legal heirs, the children said they were entitled to their respective shares in the personal assets of their father in accordance with inheritance laws. They also want the court to appoint a local commission to effect the partition of the assets.Sunjay Kapur died after a heart attack in the UK at the age of 53. At the time he was chairman of the auto component business Sona BLW Precision Forgings, which was founded by his late father, Surinder Kapur.
