Incident & reaction
New Delhi, September 26, 2025 — The Supreme Court of India has permitted the manufacturing of green firecrackers in Delhi and the National Capital Region (NCR), subject to stringent conditions. The ruling allows certified manufacturers to produce these eco-friendly crackers but prohibits their sale and storage within the NCR until further orders. This decision aims to balance the livelihood concerns of workers with the imperative to control air pollution during the Diwali festival.
The bench, comprising Chief Justice BR Gavai, Justices K Vinod Chandran, and NV Anjaria, emphasized the need for a balanced approach. It acknowledged that a complete ban might not be practical and could lead to unintended consequences, such as illegal manufacturing activities. Therefore, the court allowed certified manufacturers to continue production, provided they submit an undertaking to ensure that the crackers are not sold in the NCR.
Context & implications
Green firecrackers are designed to be less polluting than traditional ones, as they are made with modified formulations that reduce harmful emissions. However, the Supreme Court’s decision underscores the ongoing challenges in enforcing environmental regulations and the complexities involved in balancing economic activities with public health concerns.
The court has directed the Ministry of Environment, Forest and Climate Change (MoEFCC) to consult all stakeholders, including the Delhi government, manufacturers, and sellers, to devise a comprehensive policy. The next hearing is scheduled for October 8, 2025, when the court will review the progress and consider further measures.
The Supreme Court’s decision to allow the manufacturing of green firecrackers while banning their sale in Delhi-NCR represents a step towards addressing the dual challenges of air pollution and economic livelihood. The forthcoming consultations and subsequent hearings will be crucial in shaping a sustainable and equitable policy for the region.
