KUCHING, Sept 18: The Ministry of Works (KKR) has assured that the implementation of proposed amendments to the Construction Industry Payment and Adjudication Act (CIPAA) and related regulations will be carried out in an orderly manner in accordance with existing legal processes.
Minister of Works Dato Sri Alexander Nanta Linggi said the ministry takes note of the proposed changes, particularly the enforcement of the A1738 Amendment Act and the issue of tax clarity on adjudicator fees, which are crucial to strengthening the construction sector’s governance.
“Under Section 33 of CIPAA 2012, the Minister of Works is empowered to make, amend, or clarify regulations to ensure CIPAA remains relevant and transparent. These powers cover procedures, fees, adjudicator charges, as well as other adjudication matters,” he explained in a post shared on his social media today.
Nanta added that he co-chaired a meeting with Minister in the Prime Minister’s Department (Law and Institutional Reform) Dato’ Seri Azalina Othman to deliberate and finalise several matters concerning taxation and adjudicator fees under the proposed amendments in Kuala Lumpur today.
He also welcomed the alignment of regulatory references from the Kuala Lumpur Regional Centre for Arbitration (KLRCA) to the Asian International Arbitration Centre (AIAC), as well as the transfer of authority to appoint adjudicators, following amendments approved by Parliament in July 2024.
“These amendments are expected to foster transparency, competitiveness, and confidence among stakeholders in the construction industry,” he said.
According to Nanta, KKR will continue working closely with the Legal Affairs Division of the Prime Minister’s Department (BHEUU), AIAC, and the Attorney General’s Chambers (AGC) to ensure a smooth and proper implementation process.
