'You are calling it inferior': Delhi HC raps Patanjali over ‘ordinary Chyawanprash’ ad, sets next hearing for Sept 23

Patanjali Ayurved on Friday moved the Delhi High Court to challenge an earlier order that barred it from airing or publishing advertisements allegedly disparaging Dabur Chyawanprash. The division bench has listed the appeal for further hearing on September 23. A division bench of Justices C Hari Shankar and Om Prakash Shukla, however, made it clear at the outset that Patanjali’s appeal may not hold much weight. The judges remarked that the statements used in the ads were a clear reference to Dabur and appeared to be a case of generic disparagement. Court’s sharp observations The bench pointed out Patanjali’s use of the line, “Why settle for ordinary chyawanprash made with 40 herbs?” noting that the reference unmistakably targeted Dabur. “When you describe 40 herbs as ordinary, the public naturally infers you are calling the respondent’s chyawanprash inferior while projecting yours as superior,” the judges told Patanjali’s counsel.Live Events The court further remarked that the single judge’s earlier decision—treating the advertisement as disparaging and granting an interim injunction—was discretionary in nature and did not warrant interference. It warned Patanjali that if the current appeal was found to be “luxury litigation” or frivolous, costs would be imposed. “These are clearly disparaging statements,” the bench added, citing other lines from the ad that suggested rival manufacturers lacked knowledge of Ayurvedic texts and traditions. “You have painted everyone else in black, implying they don’t know how chyawanprash is made. Why should we entertain such an appeal?” The judges also cautioned against unnecessary appeals, observing, “We will not allow ‘aaltu faaltu’ appeals in every matter. It’s not as if this order is going to cause irreparable damage. You have the resources to file an appeal in every case.” Background of the case The appeal stems from a July 3 order in which a single judge restrained Patanjali from publishing or broadcasting disparaging ads against Dabur Chyawanprash. Dabur had argued that Patanjali’s print and television campaigns positioned its own product as “special” while terming others “ordinary,” effectively denigrating Dabur’s product and chyawanprash in general. The court at that time ordered Patanjali to delete the phrase “Why settle for ordinary chyawanprash made with 40 herbs?” from its advertisements. It also highlighted that the television commercial was narrated by Baba Ramdev himself—whose public standing as a yoga and Ayurveda authority amplified the impact of the claims. Dabur’s petition alleged that Patanjali had made “false and misleading” claims suggesting other manufacturers lacked knowledge of Ayurvedic scriptures or authentic formulas for chyawanprash. Such messaging, Dabur said, not only singled out its product but also cast aspersions on the entire chyawanprash industry.
