The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has secured a significant legal victory, as the High Court of the Federal Capital Territory in Abuja, presided over by Justice Josephine Obanor, dismissed a suit seeking to block its investigation into alleged financial impropriety in the administration of Kano State’s scholarship funds.
The ruling, delivered on September 16, 2025, reaffirms the ICPC’s statutory mandate to conduct investigations into corruption allegations.
The case stemmed from a petition received by the ICPC, which prompted the commission to invite officials from the Kano State Ministry of Higher Education and the Kano State Scholarship Board to provide documents and clarifications.
However, the officials, led by Dr. Hadi Bala, the Permanent Secretary of the Ministry of Higher Education, filed Suit No. CV/2857/2025 against the ICPC and the Attorney-General of the Federation, claiming the invitations violated their fundamental rights.
In her judgment, Justice Obanor ruled that the Kano State Scholarship Board officials should be properly joined as parties in the suit and struck out the Attorney-General of the Federation as an unnecessary party.
The court further held that an ICPC invitation for investigation purposes does not constitute a breach of fundamental rights.
Finding no evidence of rights violations, the judge dismissed the suit for lack of merit, thereby upholding the ICPC’s authority to investigate allegations of corruption.
The ICPC, in a statement, welcomed the ruling, emphasizing its commitment to transparency, accountability, and justice in Nigeria’s public sector.
“This ruling reinforces the Commission’s authority to investigate cases of alleged corruption and financial misconduct in line with its statutory mandate,” the statement read.
The ICPC assured Nigerians that it will continue to operate within the bounds of due process and the rule of law as it probes the Kano scholarship funds case.
