The Bombay High Court has ordered that teachers who passed the Teacher Eligibility Test (TET) after the March 2019 deadline can continue with their service while being eligible for promotions if they were appointed after TET was made mandatory in 2013. The court stated that “the impugned orders refusing approval to their transfer from the unaided establishment to the aided establishment, on account of failing to acquire TET prior to March 31, 2019, shall stand quashed and set aside in cases wherein the petitioners have acquired the TET/CTET qualification.” Earlier Ban on Transfers and Promotions Now Lifted The HC’s verdict follows the writ petitions filed by teachers Sagar Dattatray Chorghe and Sangeeta Ramchandra Salunke, who were appointed in 2013 but did not clear TET at the time and later passed the Central Teacher Eligibility Test (CTET) in 2021. Their transfer from unaided posts to aided posts was previously blocked by the state authorities due to the missed deadline. In 2021, the HC adhered to the decision and stated that teachers who could not clear the test by March 31, 2019, would not be able to claim benefits like transfer, approval, or promotion. However, the recent judgement quashes that ruling. The bench cited the SC’s judgment on the TET mandate for teachers appointed prior to the enactment of the Right to Education Act. The court said that though TET is mandatory, teachers who cleared it later could not be deprived of service continuity or career progression. HC Allows Teachers to Continue Service Despite Missing TET Deadline Therefore, the High Court stated that teachers appointed after 2013 should not face termination or denial of promotions because they cleared the test after the March 2019 cut-off. Thus, the court ordered that the petitioners’ transfer from unaided to aided posts be approved.
