New Delhi: In a major relief for shopkeepers, traders and business owners, the Maharashtra government has officially allowed most shops and establishments in the state to remain open 24 hours a day. This significant decision was confirmed through a fresh circular issued by the Industries, Energy, Labour and Mining Department. However, establishments dealing with alcohol, such as permit rooms, beer bars and wine shops, will continue to operate under existing restrictions and are not permitted to function round the clock.
Clarification to end confusion
The decision comes in response to a series of complaints from business owners who alleged that local authorities and police were preventing them from keeping their shops open all night. Many argued that there was ambiguity in the interpretation of the Maharashtra Shops and Establishments Act, 2017, which led to unnecessary harassment. To address these concerns, the government has now issued a detailed clarification, making it clear that businesses are legally allowed to function 24×7, provided they follow certain rules and conditions.
Officials stated that the move is aimed at easing business operations, reducing unnecessary restrictions and providing greater flexibility to shopkeepers and service providers. This change is expected to boost the state’s retail and service sectors by enabling continuous operations and catering to customer needs beyond traditional business hours.
Weekly rest mandatory for employees
While businesses have been granted the liberty to remain open throughout the day and night, the state government has emphasised that the welfare of workers must remain a priority. As per the Maharashtra Shops and Establishments Act, 2017, every employee must be given a weekly break of at least 24 consecutive hours.
This provision is designed to protect workers’ rights and ensure that employees receive sufficient rest, even if their workplace operates without closing. Employers will need to carefully design shift patterns and schedules to comply with this law. Authorities have underlined that failure to provide such rest periods could invite legal action.
The government has already informed local administration and the police about the new rules, making them responsible for ensuring compliance. Both business owners and law enforcement officers are expected to work in coordination to implement the guidelines smoothly.
Theatres and cinemas gain flexibility
Another major highlight of the circular is the removal of restrictions on theatres and cinemas, which were previously bound by fixed working hours. With the updated notification, these entertainment venues are now free to operate with extended or continuous timings, similar to other shops and establishments.
This decision is expected to be particularly beneficial for multiplex chains, single-screen theatres and event venues, which often see demand for late-night or early-morning shows. Industry experts believe that this step could also help revive the cinema and entertainment sector, which has been struggling in the post-pandemic period.
Boost for businesses and consumers
Business owners have welcomed the government’s move, calling it a progressive step towards creating a more dynamic business environment. Continuous operations will allow shops, restaurants, theatres and other establishments to serve customers at any time, thereby improving convenience for consumers.
From small kirana stores to large retail chains, extended hours are expected to attract more customers, particularly in urban areas where demand for round-the-clock services is high. Additionally, the hospitality, transport and food delivery sectors may also benefit indirectly, as they often rely on businesses being open late into the night.
Economists point out that 24×7 operations could enhance the state’s ease of doing business index and attract more investment in the retail and service sectors. Maharashtra, being a hub of trade and commerce, could see increased economic activity and job creation as a result of this decision.
By officially clarifying that shops, establishments and entertainment venues can operate 24×7, the Maharashtra government has addressed long-standing grievances of business owners. The decision is set to bring more flexibility and efficiency to the retail and service industries, while ensuring that employees’ rights are safeguarded through mandatory weekly rest provisions. For consumers, this change means greater accessibility and convenience, marking a step towards aligning the state’s business ecosystem with global practices.
